Terms of sale

Article 1 — Purpose and seller

These terms and conditions of sale govern sales concluded on the website memoracadres.com (the "Website") between:

- The seller: GC SHOPPING WORLD LLC, a limited liability company under United States law (Limited Liability Company), registered in the State of New Mexico (United States) under entity number 0008127799, whose registered office is located at 1209 Mountain Rd Pl NE, Ste R, Albuquerque, NM 87110, United States, operating the Website under the brand "Memora" (hereinafter "Memora"). Contact: contact@memoracadres.com

- The customer: any natural or legal person making a purchase on the Website (hereinafter the "Customer").

Any order constitutes unreserved acceptance of these terms and conditions, in the version in force on the date of the order.

Article 2 — Product

Memora offers a 3D relief frame made from a child's drawing supplied by the Customer, in A4 format, at a price of €150 including all taxes, delivery included. The frame colour is chosen by the Customer when ordering, from the colours offered on the product page.

The relief faithfully reproduces the lines of the drawing sent. Colour reproduction is faithful but not identical: a difference in shade between the original drawing, its display on screen and the frame received is inherent to the process and does not constitute a defect.

Manufacturing is entrusted to a specialist partner workshop.

Article 3 — Order

The order is placed directly on the Website. The Customer uploads a photo or scan of the drawing. Only one order may be placed per drawing and per basket.

By sending the drawing, the Customer declares that they are the parent or legal guardian of the child who made the drawing, or that they have their permission.

The photo sent is checked automatically as soon as the order is recorded. If it does not allow a compliant frame to be made — drawing too faint, blurred photo, incomplete framing — the order is cancelled and refunded in full, and the Customer is informed by email. The Customer is then free to order again with another photo.

Article 4 — Price and payment

Prices are those displayed on the Website at the time of the order, expressed in euros and including all taxes. Delivery is free: its cost is included in the price displayed, and no shipping costs are added at the time of payment.

Payment is due immediately upon ordering, by the methods offered on the Website.

Article 5 — Manufacturing and delivery

As each frame is made to order, the manufacturing and delivery time is 15 to 20 days from the order, and no more than 30 days. The areas served and the shipping arrangements are set out in the Shipping Policy.

For deliveries within the European Union, the price displayed is the final price; no additional charges are requested on receipt. Outside the European Union, any customs duties are payable by the Customer.

Article 6 — Right of withdrawal

Each frame is made from the Customer's own drawing and exists in only one copy. In accordance with Article L.221-28 3° of the French Consumer Code, the fourteen-day right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised.

The Customer is informed of this on the product page, in the Refund Policy and at the time of payment, and expressly accepts it by confirming their order. Once manufacturing has started, the order can no longer be cancelled.

As long as the confirmation that manufacturing has started has not been sent, the Customer may write to Memora: if nothing has been started yet, the order is cancelled and refunded.

Article 7 — Statutory guarantees

The exclusion of the right of withdrawal in no way affects the statutory guarantees, which apply in full:

- the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code), for two years from delivery;

- the guarantee against latent defects (Articles 1641 et seq. of the French Civil Code), for two years from the discovery of the defect.

These guarantees are free of charge and independent of any commercial gesture. Memora bears the cost of replacing or refunding the frame in the event of breakage occurring during transport, a manufacturing defect or non-conformity with the order, under the conditions set out in the Refund Policy.

Damage resulting from abnormal use, an impact after receipt or prolonged exposure to humidity or heat is excluded.

Article 8 — Liability

Memora cannot be held liable for damage resulting from misuse of the product. In the event of a delay attributable to the carrier, Memora follows up the case and, if the parcel is lost, remakes the frame at its own expense.

Article 9 — Ownership of the drawing

The drawing sent remains the exclusive property of the Customer and their family. Memora uses it only to manufacture the order concerned, and does not publish it or use it for promotional purposes without the Customer's prior written consent.

Article 10 — Personal data

The processing of the Customer's personal data, including the drawing sent, is described in the Website's Privacy Policy.

Article 11 — Applicable law and disputes

These terms and conditions are governed by French law. A Customer who is a consumer residing in another Member State of the European Union retains the benefit of the mandatory protective provisions of their country of residence.

In the event of a problem, the Customer is invited to write to Memora first, which undertakes to seek an amicable solution: most situations are resolved in a few messages.

Failing an amicable resolution, the dispute may be brought before the competent courts.
